Tim Schrei­ber is a ver­sa­ti­le dis­pu­tes att­or­ney who repres­ents cli­ents in inter­na­tio­nal arbi­tra­ti­on and sta­te court pro­cee­dings as well as in various types of alter­na­ti­ve dis­pu­te reso­lu­ti­on pro­cee­dings. His prac­ti­ce focu­ses on the aero­space, auto­mo­ti­ve, ener­gy oil & gas, for­eign invest­ment and tech­no­lo­gy sec­tors. He also fre­quent­ly repres­ents cli­ents from the banking/financial ser­vices, defence and engi­nee­ring sec­tors. Tim is a lea­ding figu­re in the reso­lu­ti­on of inter­na­tio­nal dis­pu­tes in Eas­tern and Sou­the­as­tern Euro­pe, whe­re he has advi­sed and repre­sen­ted various local govern­ments and lea­ding indus­tri­al com­pa­nies in com­mer­cial and invest­ment arbi­tra­ti­ons for more than 15 years. Arbi­tra­ti­on

Tim Schrei­ber is an arbi­tra­ti­on spe­cia­list who has con­duc­ted dozens of arbi­tra­ti­ons befo­re various arbi­tral insti­tu­ti­ons. He is acti­ve in both com­mer­cial and invest­ment arbi­tra­ti­on and repres­ents cli­ents in arbi­tra­ti­on-rela­ted court and in enforce­ment pro­cee­dings. His main area of prac­ti­ce here are joint ven­ture and pro­ject dis­pu­tes (often invol­ving sta­tes or sta­te-owned enter­pri­ses), post‑M&A pro­cee­dings and long­term sup­p­ly con­tracts. In 2019, he was reco­g­nis­ed by Best Lawy­ers as one of the 5 “Lawy­ers of the Year” for inter­na­tio­nal arbi­tra­ti­on in Ger­ma­ny. Tim is a gra­dua­te of the Lon­don School of Inter­na­tio­nal Arbi­tra­ti­on at Queen Mary Uni­ver­si­ty of Lon­don and a lec­tu­rer for arbi­tral law at the Uni­ver­si­ty of Frank­furt am Main. Tim Schrei­ber has plea­ded com­plex com­mer­cial dis­pu­tes befo­re Ger­man civil courts, e.g., mass actions fol­lo­wing alle­ged brea­ches of ad-hoc dis­clo­sure obli­ga­ti­ons, direc­tors’ and offi­cers’ lia­bi­li­ty cases (inclu­ding in rela­ti­on to ABS acqui­si­ti­ons pri­or to the finan­cial cri­sis), pro­cee­dings regar­ding cum-ex tran­sac­tions, and anti­trust pro­cee­dings. Howe­ver, the majo­ri­ty of his civil liti­ga­ti­on prac­ti­ce rela­tes to long-term purcha­se- or ser­vice agree­ments in an inter­na­tio­nal envi­ron­ment and dis­pu­tes fol­lo­wing M&A acti­vi­ties. He also assists banks or liti­ga­ti­on fun­ders in asser­ting their rights in pro­cee­dings for inte­rim reli­ef and enforce­ment proceedings.

Media­ti­on and other alter­na­ti­ve dis­pu­te reso­lu­ti­on procedures 

The ami­ca­ble sett­le­ment of dis­pu­tes – inclu­ding through media­ti­on or struc­tu­red nego­tia­ti­ons – is a par­ti­cu­lar focus of Tim Schrei­ber’s prac­ti­ce. He has assis­ted cli­ents not only in num­e­rous sett­le­ments, but also in the media­ted sett­le­ment of com­plex legal dis­pu­tes, some of which invol­ved very high amounts in dis­pu­te. Due to his out­stan­ding achie­ve­ments in Liti­ga­ti­on and ADR, Tim was reco­g­nis­ed by Best Lawy­ers as one of the 6 “Lawy­ers of the Year” for Dis­pu­te Reso­lu­ti­on in Ger­ma­ny in 2018.
